Access to and use of the website available at the address https://www.3bmeteo.com/ ("Website"), owned by 3BMeteo S.r.l., with registered office at Don Carlo Botta 13, Bergamo (BG), VAT number 04193510163, PEC [email protected], Tel. +39 0354158611 ("3BMeteo"), and the use of the related services ("Services") offered to the user ("User") are governed by these general terms of use ("General Terms of Use"). These General Terms of Use may be subject to changes by 3BMeteo. Therefore, the User is kindly requested to verify these General Terms of Use from time to time.
Preamble
The economic model of 3BMeteo is based on the installation of Profiling Cookies or, alternatively, on the acceptance of these General Terms of Use to allow the User to enjoy the Services made available through the Website.
Therefore, the following alternative is offered to the User:
- Easy Level: If you do not accept the installation of Profiling Cookies and do not subscribe, you will be granted access only to the Easy Services, through Technical Cookies;
- Standard Level without profiling: You can enjoy the Standard Services offered through the Website by subscribing for 6 Euros per year and accepting these General Terms of Use. Please note that in this case, you may still receive non-personalized advertisements;
- Standard Level with profiling: You can give your consent to the installation of Profiling Cookies, thus supporting the financing of the Website, without any subscription. You can withdraw your consent at any time, as specified in the Privacy Policy.
- Pro Level: You can enjoy the Standard Service and additional Services offered through the Website by subscribing to 3B+, as well as accepting these General Terms of Use.
Definitions
The following terms and expressions will have the meanings indicated below, which will remain the same, both in singular and plural:
“3B+”: means additional Services offered under the following conditions: payment of the 3b+ subscription, which removes advertising from the website;
“Account”: means the set of User identification data to allow access to the Website in case of non-consent to the Processing of Personal Data;
“Content”: means any data in textual, verbal, or figurative form published on the Website;
“Cookie”: means small text strings sent by the Website to the browser, which stores them to resend them to the Website upon the User's next visit;
“Profiling Cookies”: means Cookies aimed at adapting the advertising displayed to the User;
“Personal Data”: means any information concerning an identified or identifiable natural person, directly or indirectly, with particular reference to an identifier such as a name, an identification number, location data, an online identifier, or one or more characteristic elements of their physical, physiological, genetic, mental, economic, cultural, or social identity;
“Price”: means the sum of money or digital representation of value due for the use of the Services;
“Profiling”: means any form of automated Processing of Personal Data consisting of the use of such Personal Data to evaluate certain personal aspects relating to the User, in particular to analyze or predict aspects concerning professional performance, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements of that natural person;
“Easy Services”: means the Services coinciding with access to the information on the Website's homepage;
“Services”: means access to the Content of the Website, according to different methods;
“Standard Services”: means the Services offered through the Website, denying the installation of Profiling Cookies;
“Processing”: means any operation or set of operations, performed with or without the use of automated processes and applied to Personal Data or sets of Personal Data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment or combination, restriction, erasure, or destruction.
Subject
The General Terms of Use govern the access and use of the Website, as well as the use of the Content and Services made available through the Website by the User, without the User having consented to the installation of Profiling Cookies and the related Processing of their Personal Data. It is understood, in any case, that the User may still view non-profiled advertisements if they have consented to the installation of the corresponding Marketing Cookies.
The General Terms of Use regulate the provision of the Website and the use of its Services, subject to the payment of the Price, as further specified, through the creation of an Account.
Duration
- Easy Level: Allows free access to the homepage with or without consent. Reference is made to the existing Terms and Conditions of use of the Website.
- Standard Level without profiling: Allows browsing the website by rejecting profiling after paying the annual subscription of 6 euros.
- Standard Level with profiling: Allows free browsing of the entire site simply by accepting profiling for 6 months.
- 3B+: Allows viewing the site without ads based on the chosen monthly, quarterly, or semi-annual plan.
Account Creation
To use the Standard Services and the 3B+ Service, it is necessary to create an Account. To create the Account, the User must fill out and submit the appropriate registration form, providing their Personal Data truthfully and correctly. 3BMeteo reserves the right to verify that the email provided by the User is correct by sending an appropriate email to the User and requesting the opening and consultation of the link contained therein. Once the Account is created, the User can access the Website, use its Services, and view its Content.
Before proceeding with the payment of the Price in accordance with the methods indicated therein, the User is invited to carefully read these General Terms of Use, print a paper copy or store a copy on a durable medium that allows them to retain the personally addressed information so that they can access it in the future for a period of time adequate to the purposes for which it is intended and which allows for the identical reproduction of the information stored therein. A copy of the General Terms of Use will be sent to the User via email. The Standard and Pro Services will be considered purchased by the User at the moment when 3BMeteo receives, electronically, the User's request, subject to the successful payment of the Price. With the purchase request, the User confirms that they have understood and accepted the General Terms of Use, as well as the additional information contained on the Website. The General Terms of Use in force at the time of the transmission of the User's request to purchase the Standard and 3B+ Services will be applicable to the relationship between the User and 3BMeteo.
Price and Payment Methods
To access the Website, use the related Services, and view its Content without consenting to the installation of Profiling Cookies and the related Processing of their Personal Data, the User is required to pay the Price, which is €6 annually for Standard Services and €1.89 per month for 3B+.
The User can make the payment of the due Price through Stripe using a credit card or other payment methods indicated on the Website. Once the payment methods are chosen, the User can proceed with the payment of the Price securely. The credit card details transmitted during the electronic purchase procedure, such as card number, expiration date, and CVV code, are protected and transmitted directly to the banking institution that handles payments. The payment takes place directly on a secure server and is protected with SSL encryption to ensure the absolute security of the transaction. In the case of payment through Stripe, the web session will be transferred to Stripe's secure website. On that site, the User can make the payment of the Price using their Stripe account, following the terms and conditions of use provided by the Stripe service, subscribed to by the User at that time or previously. This way, the User does not communicate their financial information to 3BMeteo. The charge of the Price to the Stripe account occurs simultaneously with the sending of the payment confirmation. The Price cannot vary depending on the selected payment method.
Security of Credentials
Only the User should use the Account credentials. The Account credentials should not be transferred to third parties. The User undertakes to keep them secret and to ensure that no third party has access to them, adopting all suitable security measures to reduce the risks of unauthorized or unauthorized access not compliant with their Account. The User agrees to promptly inform 3BMeteo if they suspect any unauthorized, prohibited, or non-compliant access to their Account. 3BMeteo reserves the right to verify that the archived email is correct by sending an appropriate email to the User and requesting the opening and consultation of the link contained in the email itself. The User guarantees that the personal information provided during the registration process, as well as in subsequent stages, is complete and truthful.
Withdrawal
The User expressly acknowledges and accepts the loss of the right to "rethink" regarding the use of Content and Services through the Website, in accordance with Article 59, paragraph 1, letter O of the Consumer Code.
The User can withdraw at any time in advance through a dedicated section in their personal profile. It is understood that for any clarification, the User can contact 3BMeteo via email.
Intellectual Property Rights and Trademarks
The Website, considered in its entirety, as well as all the material contained therein, is protected by copyright laws and other intellectual property rights.
The content, materials, databases, works published or otherwise present on the Website, including, by way of example and not exhaustively, trademarks, logos, images, photographs, press releases, and documents in general reproduced, as well as the application software, HTML codes, are the exclusive property of 3BMeteo or used with prior authorization or license from the respective rights holder.
The User may dispose of such content only if such activity is necessary for the correct use of the Website and, therefore, cannot use them freely.
3BMeteo reserves all rights over them, including, in particular, the right to publish. The dissemination of images taken from the Website is therefore prohibited.
Any other use of the aforementioned material for any purpose is prohibited without the prior consent of 3BMeteo.
Responsibility for Content
3BMeteo assumes no responsibility for the accuracy, completeness, and timeliness of the data, Content, and information owned by it or otherwise entered or contained on the Website and/or linked websites. The User is required to verify the accuracy of the information provided on the Website before making any decision. 3BMeteo disclaims any responsibility for errors or omissions resulting from the use of data and information present on its Website. The User accepts that communications made through the Website (including email communications) are not of a confidential nature.

The hyperlinks on the Website may lead the User to web pages of third parties.
The User acknowledges and recognizes that 3BMeteo has no control over the content of such sites and, as a mere third party, has no responsibility for the content and/or material, including advertising material, disseminated there or for external resources or products or services offered.

Applicable Law and Competent Court
These General Terms of Use are governed by Italian law. In case of a dispute arising from the interpretation and/or application of these General Terms of Use, the court of the place of domicile or residence of the User will have jurisdiction to decide on the matter.
